<p>On Dec, 20, 2020, the U.S. Department of Transportation (DOT) published a final rule for defining unfair or deceptive practices (UDP) by air carriers, as well as the agency’s procedures for rulemaking actions in response to alleged violations. Those procedures were ostensibly simplified by a DOT final rule published on Feb. 2, 2022. A new notice of proposed rulemaking (NPRM) now aims to rescind the 2022 UDP rule and to reinstate the procedures in the 2020 UDP rule, because the DOT under the Trump Administration claims the 2022 rule “was done without notice and comment and because it is unnecessary.” However, when the DOT published the 2022 rule, it said “normal notice and comment procedures do not apply to an action that is a rule of agency organization, procedure, or practice.” Comments on the NPRM are due by December 1, 2025.</p>
